1. Introduction: Profitex is a marketplace for buying and selling products, services, and courses. We utilize an innovative method called Community Commerce (C-commerce) to market products through our community.
2. User Accounts:
• Any user can start a Profitex account for free.
• Users can promote and earn with their free account.
• When the wallet reaches ₹169, the user is automatically upgraded to the Profitex Plus Subscription, and ₹169 is charged for the upgrade.
• Users who do not wish to auto-upgrade must inform us by emailing support@profitex.io before registering. They must communicate with the Profitex Office to continue with the free plan.
• Once the account is created and auto-upgraded, we cannot revert the upgrade. Avoiding the auto-upgrading process is entirely the user's responsibility, and the company will not be held responsible.
3. Promotion and Earnings:
• Users can promote products and ads at their own risk and interest.
• Profitex operates in both B2B and B2C business models and collaborates with many services. We are not responsible for issues arising from third-party companies, brands, or products.
• Profitex Plus Subscription costs ₹169 + 18% GST. Users can upgrade by paying this amount after reading the complete policies and benefits. We do not provide refunds. Please read and analyze everything carefully.
• We encourage users to create a free account first and upgrade to Plus only if satisfied with Profitex.
4. Affiliate Commissions and Reward Points:
• Affiliate commissions are given for each referral.
• Users can earn points with referrals. These reward points can be used for purchasing products on Profitex or withdrawing directly to their bank account.
• 5% TDS and 5% processing fee are deducted from each withdrawal.
• Users must have a valid bank account and PAN card for withdrawals.
5. User Responsibilities:
• We are not responsible for users promoting and misleading the platform for their needs. Users should follow the company's official data.
• Any legal issues or complaints must be raised in Kozhikode district, Kerala. The communication language should be English.
6. Subscription and Reward Related Issues:
• We are not responsible for:
o Subscription amount-related issues
o Reward-related issues
o Issues related to other companies (Profitex-collaborated)
7. Rewards and Promotional Activities:
• Rewards are based on our turnover and ad spending.
• We do not offer this method long-term. Profitex can stop such promotional activities anytime and may increase or reduce rewards.
• Rates, values, points, methods, and everything on our platform are subject to change.
8. Data Usage:
• We use users' data for our company ecosystem.
9. Queries and Complaints:
• For queries and complaints, users can raise a complaint on the Profitex website or email support@profitex.io.
• We do not provide any person or medium for communication to the company outside of these options.
10. Account Deletion Rights:
• Profitex reserves the right to delete or permanently delete users' accounts for the following reasons:
1. Misleading Promotion
2. Manipulated values and documents while promoting
3. Creating or publishing company details on their own platforms
4. Dissemination of disinformation
11. Use of Company Assets:
• Users are not permitted to use Profitex's name, logo, or documents without explicit permission from the Company's Managing Director.
• Legal action will be taken against users who create social media platforms using the Profitex name without permission.
12. Jurisdiction and Legal Matters:
• Any disputes or legal matters must be addressed in Kozhikode district, Kerala, and the communication language should be English.
For any queries and complaints, you can directly raise a complaint on the Profitex website or email support@profitex.io. Users cannot use calls or messages for communication with Profitex.
Legal Rules and Regulations
1. Governing Law:
• This agreement and any dispute arising from it shall be governed by and construed in accordance with the laws of India, specifically under the jurisdiction of Kozhikode district, Kerala.
2. Jurisdiction:
• All disputes, claims, and legal actions must be initiated and conducted in Kozhikode district, Kerala. The communication language for any legal proceedings shall be English, per the Arbitration and Conciliation Act, 1996.
3. Data Protection and Privacy:
• User data is protected under the Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. Profitex ensures compliance with these regulations to safeguard user data.
4. Intellectual Property:
• Unauthorized use of Profitex’s name, logo, or documents is prohibited. Legal action will be taken under the Intellectual Property Rights (IPR) laws of India. Users must seek explicit permission from the Managing Director for any usage of the company’s intellectual property.
5. Contractual Obligations:
• The Indian Contract Act, 1872, governs all agreements and contracts made between Profitex and its users. Implied consent and acceptance are integral to the user agreements, particularly regarding automatic subscription upgrades and data usage policies.
6. Consumer Protection:
• The Consumer Protection Act, 2019, governs all transactions made on Profitex. Users are encouraged to thoroughly review all terms and conditions to understand their rights and obligations.
7. Compliance with Tax Laws:
• All financial transactions, including affiliate commissions and reward points, are subject to the Income Tax Act, 1961, and applicable Goods and Services Tax (GST) laws. Profitex will deduct 5% TDS and a 5% processing fee from each withdrawal in compliance with these laws.
8. Anti-Money Laundering:
• Users must provide valid bank account and PAN card details for withdrawals, in line with the Prevention of Money Laundering Act, 2002. Profitex reserves the right to request additional documentation if necessary.
9. Dispute Resolution:
• Any disputes arising out of or in connection with this agreement shall be resolved through mediation and arbitration as per the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Kozhikode, Kerala.
10. Amendments and Modifications:
• Profitex reserves the right to amend these terms and conditions at any time. Users will be notified of significant changes through the platform. Continued use of the service constitutes acceptance of the revised terms.
11. Limitation of Liability:
• Profitex disclaims all liability for indirect, incidental, consequential, or punitive damages arising from the use of the platform. The company’s total liability shall not exceed the amount paid by the user for the specific service or product in question.
12. User Responsibility:
• Users are responsible for complying with all applicable laws and regulations. Profitex is not liable for any user actions that violate these laws or the terms and conditions of the platform.
